Sweven Technologies, Inc. operates internationally, including in the United States and Europe.
2. Eligibility
You must be at least 18 years old and able to form a legally binding agreement to use our Services.
3. Account Registration
To access certain features, you must create an account. You agree to:

4. Subscription Plans and Billing
Monthly Subscriptions
Sweven is offered on a month-to-month subscription basis unless otherwise stated.
Annual Billing
Annual plans may include promotional pricing (such as two months free), subject to checkout terms.
Usage-Based Charges
Messaging services (including SMS, email, or third-party communication tools) may incur additional usage-based fees.
5. Refund Policy (No Refunds)
Sweven is a software subscription service. All payments are final and non-refundable, similar to other subscription software platforms.
Once a billing cycle begins, we do not provide refunds or credits for:
Partial months of service
Unused time
Account inactivity
Downgrades
Early cancellation
To avoid being charged for the next billing cycle, you must cancel your subscription before your renewal date shown in your account.
If you cancel, you will retain access through the end of your current paid period.
This policy applies to the maximum extent permitted by law. Certain jurisdictions may provide mandatory consumer rights that cannot be waived.
6. Acceptable Use
You agree not to misuse the Services. You may not:
Use Sweven for unlawful, harmful, or fraudulent purposes
Send spam or unsolicited marketing messages
Violate messaging regulations (TCPA, CAN-SPAM, GDPR, ePrivacy)
Attempt unauthorized access or disrupt system performance
Sweven may suspend or terminate accounts that violate these Terms.
7. AI Features Disclaimer
Sweven includes AI-powered agents and automation tools. You acknowledge that:
AI responses may not always be accurate or complete
AI tools may generate incorrect or unexpected outputs
You are responsible for reviewing and approving AI-driven actions
Sweven is not liable for decisions made solely based on AI-generated content
AI features are provided as assistance, not professional advice.
8. Compliance Responsibilities
You are solely responsible for ensuring your use of Sweven complies with all applicable laws, including:
Data privacy laws (GDPR, CCPA)
Marketing and messaging laws (TCPA, CAN-SPAM, ePrivacy Directive)
Industry-specific compliance requirements
Sweven does not guarantee regulatory compliance.
9. Intellectual Property
All software, trademarks, designs, and content within Sweven are owned by Sweven Technologies, Inc. or its licensors.
You may not copy, modify, distribute, or reverse engineer the Services without written permission.
10. User Content
You retain ownership of the content you upload (contacts, workflows, templates, business data). You grant Sweven a limited license to use it solely to provide and improve the Services.
You represent that you have the legal right to use and upload such data.
11. Third-Party Services
Sweven may integrate with third-party services (payment processors, messaging providers, calendars, etc.). Sweven is not responsible for third-party performance or policies.
12. Termination
You may cancel at any time through your account settings.
Sweven may suspend or terminate access if:
You violate these Terms
Your use creates legal or security risk
Required by law
Upon termination, access ends immediately after the paid period.
13. Disclaimers
The Services are provided “AS IS” and “AS AVAILABLE.” Sweven disclaims all warranties to the fullest extent permitted by law.
14. Limitation of Liability
To the maximum extent permitted by law, Sweven is not liable for indirect or consequential damages.
Sweven’s total liability shall not exceed the amount you paid in the prior three (3) months.
15. European Union Rights
If you are located in the European Economic Area, mandatory consumer protections may apply and are not waived by these Terms.
16. Governing Law
These Terms are governed by U.S. law unless local law requires otherwise.
17. Changes
We may update these Terms at any time. Continued use of the Services constitutes acceptance.
AI Agent & Bot Disclaimer

Sweven provides AI-powered agents (“Bots”) that assist businesses with customer communication, scheduling, follow-up, and automation.
By using Sweven AI Agents, you acknowledge and agree to the following:
1. AI Agents Are Automated Tools
Sweven Bots are software-based automation systems and are not human employees, licensed professionals, or legal advisors.
2. AI Responses May Be Inaccurate
AI-generated messages may occasionally be incorrect, incomplete, outdated, or inappropriate depending on configuration and context.
You are responsible for reviewing workflows and ensuring responses are appropriate for your business.
3. No Professional Advice
Sweven AI Agents do not provide legal, medical, financial, or regulatory advice.
Any information provided by Bots is for general automation purposes only.
4. Customer Data and Compliance
You are responsible for ensuring that your use of Bots complies with:
GDPR and privacy laws
TCPA and marketing consent requirements
Industry-specific regulations
Sweven does not guarantee compliance.
5. Limitation of Liability
Sweven is not liable for actions, decisions, or outcomes resulting from AI-generated communications or automated workflows.

This Data Processing Addendum (“DPA”) applies when Sweven processes Personal Data on behalf of a Customer under GDPR.
1. Roles
Customer = Data Controller
Sweven Technologies, Inc. = Data Processor
2. Scope
Sweven processes Personal Data only to provide:
CRM services
AI agents
Messaging automation
Scheduling and lead capture tools
3. Processor Obligations
Sweven agrees to:
Process data only on documented instructions
Maintain confidentiality
Implement appropriate security safeguards
Assist with GDPR rights requests where applicable
Notify Customer of personal data breaches as required
4. Subprocessors
Customer authorizes Sweven to engage subprocessors for hosting, analytics, messaging, and payments.

5. International Transfers
Where required, Sweven relies on lawful transfer mechanisms such as:
Standard Contractual Clauses (SCCs)
Adequacy decisions
6. Data Retention and Deletion
Upon termination, Sweven will delete or return Customer Personal Data, subject to legal obligations.
